South Korea May Postpone 22% Crypto Tax Beyond January 2027

South Korea’s ruling Democratic Party has formally asked the government to postpone the country’s planned cryptocurrency tax again, arguing that a broader digital-asset framework should be enacted before investors begin paying tax on crypto gains.

Democratic Party leader Kim Min-seok announced the proposal at the party’s Supreme Council meeting at the National Assembly on November 4. The tax is currently scheduled to take effect on January 1, 2027, imposing a combined 22% levy on annual income from transferring or lending crypto assets above a 2.5 million won basic deduction.

If lawmakers approve another postponement, it would be the fourth delay since the regime was introduced through amendments to the Income Tax Act in 2020.

Why Does the Ruling Party Want Another Delay?

Kim said the party reached its position after consultations between the government and lawmakers, discussions within the National Assembly’s Strategy and Finance Committee and meetings with digital-asset businesses.

“We agreed that it would be better to first enact the Digital Asset Basic Act to build an overall framework and allow time for companies and investors to adapt,” Kim said, according to South Korean media.

The proposed legislation is expected to address areas including exchange regulation, stablecoin issuance and broader oversight of digital-asset businesses. South Korea is simultaneously developing other crypto rules, including plans to bring stablecoin payments under its foreign exchange framework.

Kim also said the next deferral would come with a defined end date and additional preparation around overseas transaction data, IT-system testing and taxpayer guidance.

Investor Takeaway

The ruling party is no longer arguing only that exchanges need more preparation time. It is increasingly linking taxation to completion of South Korea’s wider digital-asset regulatory framework, making the tax timetable dependent on legislation that remains unfinished.

Could the Tax Be Pushed Back Until 2029?

A final postponement period has not yet been approved. Democratic Party lawmakers on the Strategy and Finance Committee have discussed a roughly two-year delay, which would move implementation from 2027 to 2029.

The presidential office had already been considering that timetable. FinanceFeeds reported in October that officials were examining a 2029 start date, partly because of concerns about obtaining reliable transaction information from overseas cryptocurrency platforms.

One issue is the OECD’s Crypto-Asset Reporting Framework, which is intended to allow participating jurisdictions to automatically exchange information about crypto transactions. South Korea is expected to begin receiving CARF information before the United States, which is scheduled to participate from 2029.

Lawmakers have argued that imposing the tax before authorities have comparable visibility into activity on major overseas exchanges could create unequal treatment between investors using South Korean platforms and those trading abroad.

Investor Takeaway

A 2029 start date remains a proposal rather than current law. Unless the National Assembly amends the Income Tax Act, the legally scheduled implementation date remains January 1, 2027.

What Would Investors Pay Under the Current Rules?

The existing framework would classify qualifying gains from crypto transfers and lending as other income. Investors would receive a basic annual deduction of 2.5 million won, with amounts above that level taxed at 20% nationally plus a 2% local income tax.

The regime has already been postponed three times. It was originally due to begin in 2022 before being moved to 2023, then 2025 and finally 2027.

Despite renewed political pressure for another delay, tax authorities have continued preparing for implementation. South Korea’s National Tax Service has been developing administrative rules and reporting systems, including procedures for calculating acquisition costs and handling activity across overseas exchanges, staking, lending and decentralized finance.

What Happens Next?

The ruling party’s proposal still requires agreement with the government and ultimately legislative action before the January 2027 deadline can change.

High-level party-government consultations are expected to determine the length of any postponement, while lawmakers must decide whether taxation should begin on a fixed later date or be tied more directly to passage and implementation of the Digital Asset Basic Act.

The debate therefore has two separate components: whether South Korea should tax crypto gains and whether the government currently has the infrastructure to apply that tax consistently across domestic exchanges, overseas platforms and private wallets.

Investor Takeaway

The latest announcement increases the probability of another legislative debate but does not itself postpone the tax. Investors remain legally subject to the January 2027 timetable until lawmakers formally change it.
